SIM card regulations: As the use of smartphones continues to surge in India, so does the alarming rise in online fraud, scams, and spam. In response to the escalating issue, the Indian government is taking decisive measures to address and mitigate the risks associated with these fraudulent activities.

The decision to overhaul the rules surrounding the purchase and sale of SIM cards comes in the wake of a significant increase in cybercrimes throughout the year 2023. The new regulations are set to come into effect on January 1, 2024, aiming to bring about substantial changes to the process of acquiring SIM cards.

New Regulations to Safeguard Users

In light of the escalating online fraud and scams accompanying the surge in smartphone usage, the government is determined to tackle these issues head-on.

Legal Ramifications for Fake SIM Cards

Under the recently passed Telecommunication Bill, individuals caught purchasing counterfeit SIM cards will face severe consequences. Offenders could be subjected to a jail term of up to three years and a substantial fine amounting to Rs 50 lakh.

Mandatory Biometric Verification

Telecom companies are now mandated to collect biometric data from every customer purchasing a SIM card. This step is crucial in preventing fraudulent SIM card transactions and ensuring strict actions against those attempting to engage in illegal activities.

Digital KYC Process

Starting January 1, 2024, SIM cards will be exclusively available through digital Know Your Customer (KYC) processes in India. This transition aims to enhance the verification system and reduce the risk of unauthorized SIM card transactions.

Overhaul of the Verification System

The new regulations dictate that SIM vendors must undergo thorough verification processes. Bulk distribution of SIM cards will be prohibited moving forward, with only those with commercial purposes eligible for bulk SIM purchases.

Mandatory Registration for Telecom Franchisees

Compulsory registration for telecom franchisees, point-of-sale agents, and SIM distributors is now in effect. Non-compliance with the new telecom regulations could result in hefty fines, with penalties of up to Rs 10 lakh imposed on dealers who fail to adhere to the rules. The government's stringent approach underscores its commitment to curbing online fraud and ensuring the security of telecommunications in the country.
