In a big shock to the LGBTQ community, Supreme Court has given the judgement that same sex marriage cannot be legalised as it lies beyond the capacity of Supreme court to make such laws.

Supreme Court's judgement noted that it lies beyond the power of Supreme Court to take any action against legalising same sex marriage in India. It comes under the jurisdiction of  legislature to make such laws.

A bench of five judges comprising  Chief Justice of India Dhananjaya Y Chandrachud and justices Sanjay Kishan Kaul, S Ravindra Bhat, Hima Kohli and PS Narasimha were on the same page about this judgement.

All the five judges had the same opinion on giving the nod to the high powered committee which was proposed the central government to study and examine the concern of the same sex couples and consider corrective measures.

Although same sex marriage is not recognised as legal, the court has recognised their demand to inhabit together without any complications and interferences.

The Chief Justice of India was of the opinion that the court cannot add or substract words from the special marriage act as per the law of 1954 law.

Muslim organisation Jamiat Ulema-e-Hind has welcomed the judgement citing that this judgement will preserve the tradition institution of marriage between a female and male.

Rashtriya Swayamsevak Sangh (RSS) also welcomed the judgement of the apex court on Same sex marriage.  Sunil Ambedkar, RSS publicity in-charge took to X(formerly Twitter) and said “The Supreme Court’s decision regarding gay marriage is welcome. Our democratic parliamentary system can seriously discuss all the issues related to this and take appropriate decisions.”
