Police said on Friday night that four teenagers were arrested in the Kokrajhar region of Assam for allegedly raping a young girl and threatening to kill her if she told anyone.
Director General of Assam Police Gyanendra Pratap Singh shared the information on social media and stated that the victim's mother had complained about the two-month-old incident at Salakati Outpost on Friday afternoon.
"Two months ago, at around 3 p.m. on the bank of the Champa River, her young daughter was gang-raped by four people as she went to take a bath. The four accused warned her not to tell anyone about the situation. However, she told her mother about the incident today, according to the DGP.
The chief cop continued by saying that after receiving the report, police launched an investigation and located the suspect.
"All four alleged defendants have been located and detained. According to reports, they are all CCLs (children in conflict with the law). The age and other details are being checked, and additional legal action is being taken," Singh tweeted.
According to the authorities, the suspects are all kids, thus their identities are being kept a secret, Singh continued.
Children in Conflict with the Law (CCL) cannot be considered as undertrial detainees and the right to bail cannot be refused, according to certain recent rulings of various high courts across the nation.
"Child in Conflict with Law (CCL) cannot be treated as an undertrial prisoner as contemplated by Section 436-A CrPC," the Madhya Pradesh high court ruled in March of last year. Because they are not covered under the Juvenile Justice (Care and Protection of Children) Act of 2015, arrests, detentions, or apprehensions are not permitted.
When a juvenile is tried as an adult for an alleged heinous crime, a bench of the Punjab and Haryana High Court ruled last year that the juvenile's right to bail under Section 12 of the Juvenile Justice Act cannot be refused.
The special bench stated in its order that although the appellant/CCL was ordered to be tried as an adult, they nevertheless qualified as juveniles under the law and could never be denied the protections of Section 12 of the Act.
The court also ruled that releasing a person would be unjust if there were any reason to believe that doing so would put them in danger of associating with known criminals, putting them in danger physically, emotionally, or morally.
