Minister Vijay Shah in trouble for commenting on Colonel Sophia, may get 7 years imprisonment

Madhya Pradesh Forest Minister Vijay Shah, who made indecent remarks against Colonel Sophia Qureshi, has got into trouble. Even after apologizing, his troubles are not decreasing. On the order of the High Court, an FIR has been sent against him for registration under Section 152 and Section 196 (1)(B) of the Indian Penal Code (BNS), 2023. If the crime is proved, he can be sentenced to a minimum of seven years and maximum life imprisonment.

On the other hand, BJP President VD Sharma and Organization General Secretary Hitanand Sharma met Chief Minister Mohan Yadav in the case of Vijay Shah.

Minister Vijay Shah in trouble

According to the police, the process of filing a case is going on on the court's order. However, the FIR has not been registered yet. Let us tell you that Minister Vijay Shah had compared Colonel Sophia Qureshi to a gutter. However a video of Madhya Pradesh Forest Minister statement also went viral on social media.

While the Court has taken suo motu action on the statement of Minister Vijay Shah. The court said that this comment made against Colonel Sophia Qureshi is very objectionable.

Statement against the unity and integrity of the country

The court also called it an insult to the unity, integrity and dignity of the army of the country. The division bench of High Court Justice Atul Shridharan and Justice Anuradha Shukla gave strict instructions to the DGP of the state in this matter.

While setting the timeline, it was said that cases should be registered against the minister within four hours. The court warned that delay in following the order will be considered contempt of court.

Arrest is possible

After this order of High Court, sword of arrest is hanging over minister Vijay Shah. Actually, the accused is exempted from arrest only in crimes punishable with less than seven years of punishment. Whereas the sections under which case has been registered against minister Vijay Shah are non-bailable and there is provision of punishment ranging from one year to life imprisonment.

In such a situation, if the police want, they can arrest him and send him to jail anytime.

Let us tell you that minister Vijay Shah had made indecent remarks against Colonel Sophia Qureshi during a meeting in Raikunda village of Ambedkar Nagar, Mhow.

Called her sister of terrorists

Minister Vijay Shah had called Colonel Sophia Qureshi the "sister" of those terrorists who killed innocent civilians in Pahalgam. Not only this, the minister had taunted Prime Minister Narendra Modi by saying that he has sent the "sister of terrorists" to the army. Now the court has termed the language of the minister as "sewer language". Said that this is not only an insult to a woman officer, but also an act that hurts the reputation of the Indian Armed Forces.

How much punishment under which section

Section 152 of the Indian Penal Code (BNS) talks about a threat to India's sovereignty, unity and integrity. This section is used when there is a possibility of inciting communal sentiments. Apart from this, this section is also applied on provocative comments against India.

This section provides for a minimum punishment of seven years imprisonment to life imprisonment. Similarly, Section 196 (1) (B) talks about inciting enmity between different communities on the basis of religion, caste, language. It provides for a punishment of three to five years.

The court termed the minister's language as "gutter language" and said that it has hurt the unity of the country and the dignity of the army.
