On the statement of Bharatiya Janata Party (BJP) MP Nishikant Dubey, the Supreme Court has appealed to maintain the dignity and prestige of the institution. However, the Supreme Court did not directly mention Nishikant Dubey's statement. He made this remark on Monday (April 21, 2025) when the Supreme Court was informed that an MP had made a comment against the Chief Justice.

Party President JP Nadda described these comments as Nishikant Dubey's personal views.

Plea against BJP MP's remarks against judiciary

Petitioner and advocate Vishal Tiwari sought permission to withdraw his PIL filed regarding hate speeches during the violence in Murshidabad, West Bengal over the Waqf Amendment Act. At that time Vishal Tiwari apprised the bench of Justice Suryakant and Justice N Kotishwar Singh of this incident.

Vishal Tiwari was referring to the statements of BJP MP Nishikant Dubey, who had said that if the Supreme Court itself has to make laws, then Parliament and Assemblies should be closed.

Supreme Court said - maintain dignity and prestige

The bench told Vishal Tiwari, "We should maintain the dignity and prestige of the institution even in allegations. In a writ petition under Article 32, the statements made should also be respectful." The court allowed Vishal Tiwari to amend his petition and asked him to bring something concrete to the Supreme Court. The BJP distanced itself from Nishikant Dubey's comments on the Supreme Court and on April 19, party president JP Nadda described these comments as his personal opinion.

Vishal Tiwari said in his petition that violence broke out in protest against the Waqf Amendment Act in Murshidabad district of West Bengal and North 24 Parganas and many people died and property was damaged.

BJP distanced itself from Nishikant Dubey's comments

The petition said, "For some people, this may be a good opportunity for politics and some parties use religious sentiments to gain political advantage. Instead of maintaining peace, political leaders give provocative speeches which worsen the situation.' In the petition, the Supreme Court's order of 21 October 2022 has been cited.

Vishal Tiwari said, 'No action has been taken against Chief Ministers, Ministers and political leaders holding constitutional posts who gave hate speeches.' Vishal Tiwari had requested to direct the formation of a five-member judicial inquiry commission headed by a retired Supreme Court judge to investigate the violent protests against the Waqf Amendment Act in Murshidabad district of West Bengal.
