Sometimes a minor, sometimes over 25… Petition has been filed in the SC against Samrat Chaudhary
Samrat Chaudhary: The case of filing false affidavits against Bihar Deputy Chief Minister Samrat Chaudhary is gaining political momentum. The petitioner has sought a direction to the Election Commission to immediately file a case against him under Section 125A of the Representation of the People Act, in light of the landmark 2002 Supreme Court judgment.
The petition also seeks to direct the Election Commission to initiate prosecution under Section 125A of the Representation of the People Act, 1951.

The petition also seeks to direct the Election Commission of India to remove the Deputy Chief Minister of Bihar from his office and duties. The petition also seeks to direct the Election Commission of India and all constitutional authorities to reject nomination papers where discrepancies exist.
Petition filed in Supreme Court against Samrat Chaudhary
The petition states that Samrat Chaudhary filed several affidavits as a candidate with contradictory birth dates and ages, including claiming to be a 15-year-old minor for criminal proceedings in 1995, claiming to be over 25 for the 1999 election, and later declaring contradictory ages in the 2020 and 2025 election affidavits.
Not 25 Years Old at the Time of Nomination
The 2002 Supreme Court judgment pointed out discrepancies in documents related to school admission and the Bihar Board, proving that the candidate was not 25 years old at the time of the 1999 nomination, leading the court to accept 01.05.1981 as the correct date of birth and annul the election.
Petitioner has sought a direction to the Election Commission to immediately file a case
The petition states that despite the Supreme Court's binding decision establishing constitutional ineligibility and falsification of documents, the candidate continued to file contradictory affidavits. He holds a high public office in 2020 and 2025, and no action has been taken by statutory authorities such as the Election Commission or the Governor.

Deliberate Identity Manipulation
The candidate used four different identities – Rakesh Kumar, Rakesh Kumar, Samrat Chaudhary, and Samrat Chandra Maurya – while filing his nomination papers, indicating deliberate manipulation of his identity to avoid electoral and legal scrutiny. Petitioner Priya Mishra, through lawyer Narendra Mishra, has filed a petition against Samrat Chaudhary in the Supreme Court.
