Uniform Civil Code: Uttarakhand's name recorded in history, first state to implement UCC; Know in detail

The Uniform Civil Code has implemented in Uttarakhand. Chief Minister Pushkar Singh Dhami inaugurated the code's manual and portal ucc.uk.gov.in at the Chief Servant House located at the Chief Minister's residence. Uttarakhand has become the first state to implement UCC after independence. The aim of this step is to give equal rights to all citizens.

With the implementation of Uniform Civil Code (UCC) in Uttarakhand, the state is going to achieve a historic achievement. Chief Minister Pushkar Singh Dhami will inaugurate the portal and rules of UCC in the Chief Servant House.

To implement the UCC, the state government had constituted an expert committee on 27 May 2022. This committee submitted its report to the government on 2 February 2024.

The bill was passed in the Assembly on 8 March 2024. Even though this bill has already got approval from the President on 12 March 2024.

Special arrangements have been made on technical basis for the effective implementation of UCC. An online portal has been developed for citizens and officials. For the past several days, mock drills were being conducted to test this portal, in which the problems faced earlier were resolved.

Now this portal is fully ready and has been opened for use by common citizens and officials.

Government held extensive consultations for UCC

Let us tell you that after the implementation of UCC, online registration process will be started for matters like marriage, divorce, live-in relationship, inheritance etc. This initiative will provide simplicity and transparency to the citizens on the digital platform. The state government held extensive discussions to implement UCC. In this process, meetings were held with 43 stakeholders.

A total of 72 intensive meetings were held, in which 49 lakh SMS, 29 lakh WhatsApp messages, and 2.33 lakh suggestions were received from the public. Thousands of suggestions also reached the government through post, email and handwritten medium.

According to the information provided by the government, the Uttarakhand government improved the concept of Uniform Civil Code by studying the experiences of countries like Saudi Arabia, Turkey, Indonesia, Nepal, France, Azerbaijan, Germany, Japan and Canada. Chief Minister Pushkar Singh Dhami said that this step will give a new identity to Uttarakhand.

UCC will spread equality in the society and citizens will get justice and protection of rights. This is an example for the whole country.

According to the Dhami government, with the implementation of Uniform Civil Code, Uttarakhand has become the first state in the country to take concrete steps in this direction. The government made it possible through expert committee, technical preparations, and extensive public participation.

Let us tell you that UCC will be applicable to the entire state of Uttarakhand, as well as the residents of Uttarakhand living outside the state, except the Scheduled Tribes. To implement UCC, SDM will be the Registrar in rural areas and Gram Panchayat Development Officer will be the Sub Registrar. Whereas in Nagar Panchayat - Nagar Palikas, the concerned SDM will be the Registrar and Executive Officer will be the Sub Registrar.

Similarly, in Municipal Corporation area, Municipal Commissioner will be the Registrar and Tax Inspector will be the Sub Registrar. In Cantonment area, the concerned CEO will be the Registrar and Resident Medical Officer, or the officer authorized by CEO will be the Sub Registrar. Above all these, there will be Registrar General, who will be a secretary level officer and Inspector General of Registration.

If the Registrar is unable to take action within the stipulated time, then the matter will be auto forwarded to the Registrar General. Similarly, an appeal can be made to the Registrar General against the order of the Registrar or Sub Registrar, who will dispose of the appeal within 60 days and issue an order.

To decide on the appeal against the order of the Sub Registrar within 60 days. Those who violate live-in rules or marriage laws will be reported to the police.

Generally, within 15 days and immediately within three days, all documents and information will be examined and a decision will be taken by seeking clarification from the applicant. It will be their job to impose a fine for not submitting the application on time or violating the rules, as well as inform the police, and if the marriage information is not verified, inform the parents or guardians.

What will happen now in live-in cases?

Live-in relationships established before the implementation of the Code will be considered as live-in relationships. Registration has to be done within one month from the date of occurrence. Whereas the registration of live-in relationships established after the implementation of the Code will have to be done within one month from the date of entry into the live-in relationship.

Live-in termination - One or both partners can terminate the live-in relationship online or offline. If only one partner applies, the registrar will accept it only on the basis of confirmation from the other.

If the woman becomes pregnant due to live-in, then it is mandatory to inform the registrar. It has to be updated within 30 days of the birth of the child.

What will happen on the issue of divorce?

While applying for divorce or marriage annulment, details of marriage registration, decree of divorce or marriage annulment, court case number, date of final order, details of children, copy of the final order of the court can be obtained from here.

Will can be made in three ways. This work can be done by filling the form on the portal, uploading handwritten or typed will or by uploading the will by speaking it in a three-minute video. The portal inaugurated by CM Dhami can be accessed in 23 languages.

Let us tell you that in the 2022 assembly elections, BJP had promised that it would implement UCC. Work on UCC started after the Dhami government was re-elected.
