West Bengal to Introduce Tough Anti-Rape Bill
West Bengal: The Trinamool Congress government in West Bengal is set to introduce a new anti-rape bill in the state assembly on Tuesday. The bill, named the "Aparajita Woman and Child Bill (West Bengal Criminal Laws and Amendment) Bill 2024," aims to enhance protections for women and children across the state. Chief Minister Mamata Banerjee's government has scheduled a two-day session starting Monday to present this important legislation. State Law Minister Moloy Ghatak will introduce the bill.
Key Provisions of the Bill
The bill proposes severe penalties for rape offenders:
- Death Penalty: The bill seeks to impose the death penalty on those convicted of rape if the crime leads to the victim's death or a permanent unconscious state.
- Life Sentence: It also calls for life imprisonment without the possibility of parole for convicted individuals.
Amendments to Existing Laws
The proposed bill aims to amend several existing laws, including:
- Bharatiya Nyay Sanhita (BNS) 2023: The bill proposes changes to sections related to rape, gang rape, repeat offenders, and the disclosure of victim identity.
- Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023: It seeks to modify sections related to punishment for rape and causing harm.
- Protection of Children from Sexual Offences (POCSO) Act 2012: The bill also includes amendments to this Act as it applies to West Bengal.
Changes to Investigation and Trial Procedures
- Investigation Timeline: The bill proposes shortening the investigation deadline from two months to three weeks, with possible extensions of up to 15 days if justified by a senior police officer.
- Punishment for Repeat Offenders: Repeat offenders would face life imprisonment or the death penalty, along with fines.
- Special Task Force: A new "Aparajitha Task Force," led by a deputy superintendent of police, will be established at the district level to handle these cases.
- Special Courts: The bill also proposes the creation of special courts to expedite trials. Publishing details of court proceedings without permission will be punishable with imprisonment of 3 to 5 years and fines.
Objective of the Bill
The primary goal of the Aparajita Bill is to create a safer environment for women and children in West Bengal, enhancing both legal and procedural measures to address and prevent sexual violence.
